These terms and conditions of trade apply to all my sales. Any order placed with OOMPH (“Me”, “I”) by you (“You” or “Customer”) constitutes your agreement to be bound by these terms.

1. Sales and Purchase
   1.1 Your placement of an order with me (“Order”) constitutes an offer by you to purchase goods from me on these terms. The Order is placed when it is submitted to me.
   1.2 You must not purchase goods from me for the purpose of resale.
   1.3 If I accept the Order, a binding contract between you and I will arise on these terms (the Contract).
2. Price
   2.1 Prices quoted on my website include GST and delivery costs. Unless otherwise agreed in writing, the price of the goods will be the current price on the day of order. I may change my prices from time to time without notice. I reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. I shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service. I do not guarantee, represent or warrant that your use of my Service will be fully uninterrupted, timely, secure or error-free.
   2.2 The prices I charge must be paid before I have an obligation to deliver.
3. Payment
   3.1 Payment will be in accordance with my online service by credit card. Afterpay is also available.
4. Delivery
   4.1 I shall deliver the goods to the address stated on the online order.
   4.2 I shall deliver the goods by such method I consider to be appropriate from time to time.
   4.3 The Customer agrees to inform me within 7 days of the date of order if proof of delivery is required. After this period, no liability will lie with me for proof of delivery.
   4.4 I will not be responsible for any part delivery or delay in delivery of the goods as a result of events occurring beyond my control. I will not be responsible for any consequences (direct or indirect) arising from such delay or non-delivery.
5. Guarantees
   5.1 The Consumer Guarantees Act 1993 applies to this contract and accordingly:
   (a) if any of the goods fail to comply with any guarantee in the Consumer Guarantees Act, I will replace those goods;
   (b) without excluding my obligations under the Consumer Guarantees Act 1993, the Customer acknowledges that I do not provide any Express Guarantees (as defined in that Act);
   5.2 There are otherwise no returns on sales and I do not offer refunds where you have changed your mind, or ordered incorrectly once you have received your item.
   5.3 You are responsible for the proper cleaning and maintenance of my products. You acknowledge that you have read (or viewed) my “how to use” section of my website before agreeing to purchase.
   5.4 You otherwise agree to purchase at your own risk. You expressly agree that your use of, or inability to use, the product is at your sole risk. In no case shall I be liable for any pregnancy, injury, or medical intervention, arising from your use of any products procured using the Service, or for any other claim related in any way to any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility.
6. Intellectual Property
   6.1 Everything on my websites (LISA SAID SO, and OOMPH) is copyright. I welcome the use of this site for personal use, non-commercial use, research or study – provided that the user acknowledges all copyright and other notices contained in the content.
   6.2 You may not copy or display or use for commercial purposes, any part of these sites without my express permission.
7. Governing Law
   7.1 These terms and conditions are governed by the laws of New Zealand.
